These are the rules when traveller caravans arrive on your land

Surrey Police have outlined the rules for when officers can use powers to remove travellers from private land.

The police released a statement on Wednesday (August 8) in response to a number of recent incursions in Elmbridge in areas such as Cobham , Claygate and Long Ditton .

A spokesman for the force said officers first visit the site to determine the “impact” of the camp.

“In general terms the following is what happens when we are made aware of an unauthorised encampment. Firstly we will visit the site with the landowner, to gather information and identify the exact scale, location and impact of the camp,” he said.

“Most unauthorised encampments are dealt with (appropriately) as a ‘civil law’ matter between the trespassers and the landowner – with the landowner requesting the trespassers move on and coming to a mutually agreeable position, and then following up with legal action if required.

“If the landowner hasn’t taken ‘reasonable steps’ to ask the encampment to leave their property, we are unable to use our powers under Section 61 of the Criminal Justice and Public Order Act 1994.”

The spokesman went on to say that police need to prove that the camp is having a “significant” impact on the local community before using their powers to ask the encampment to leave.

“This legislation requires us to balance the impact of the camp with the rights of the individual, and the guidance expects us to prove that the camp is having a substantial and significant impact, before we are able to use the powers within the Act available to police.

“Once we are made aware of an unauthorised encampment we will keep it under regular review to consider the use of Section 61.

“Section 62 of The Criminal Justice and Public Order also allows a police force to direct occupiers to a registered “transit” or temporary site (provided by the local authority) within the county. Surrey does not currently have any registered temporary sites.”
