Fly-tipping in Surrey: Byfleet firm fined after dumping waste outside people’s homes

Clearance company Expect a Miracle can expect to be out of pocket after Woking Borough Council successfully prosecuted them for fly-tipping.

The Byfleet firmed admitted two offences under the Environmental Protection Act 1990 at Guildford Magistrates’ Court last Monday (November 13).

Expect a Miracle, the court was told, knowingly fly-tipped controlled waste outside residential properties in Byfleet.

It also failed in its duty of care as a controlled waste carrier by not transferring the waste to an authorised person and getting a written transfer note.

After a council investigation, it also came to light that the defendant did not hold a valid waste carrier’s license.

Councillor Beryl Hunwicks, Woking’s portfolio holder for waste and recycling, said:”Businesses that trade without a lawful licence can be fined up to £5,000. Fly-tipping is a serious offence and it will not be tolerated in any circumstance.”

“Anyone transporting waste as part of their business should carry or look to obtain a license as soon as possible – whether it is their waste or someone else’s.

“This includes tradesmen such as plumbers carrying old sinks, gardeners carrying shrubs and trees and builders carrying rubble,” added Cllr Hunwicks.

The company was ordered to pay a total of £785 comprising a fine of £500, the council’s costs of £250 for bringing the prosecution to court and a victim surcharge of £35.

“These offences emphasise the importance of ensuring correct and legal waste disposal by both businesses and residents,” added Cllr Hunwicks.

Residents can check if a waste carrier has a valid licence for carrying and disposing of controlled waste by:

  • asking for a copy of the company’s waste carrier registration certificate and asking where the waste is being taken for disposal.
  • checking whether the waste carrier is registered by the Environment Agency – phone 08708 506506 or check online.
  • asking for a registered trading address and contact telephone number for the trader and obtaining a receipt.
